1. About Nithya Welfare Society

Nithya Welfare Society ("the Society," "we," "our," or "us") is a registered charitable organization under the Andhra Pradesh Societies Registration Act, 2001, with its registered office at Narakoduru, Chebrole, Guntur District, Andhra Pradesh, India – 522212. The Society is registered under Section 12A and Section 80G of the Income Tax Act, 1961, enabling donors to claim tax deductions on their contributions.

2. Acceptance of Terms

By accessing or using our website www.nithyawelfaresociety.org, making a donation, registering as a volunteer, or engaging with our programs in any manner, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our website or services.

3. Use of Website

3.1 Permitted Use

This website is intended to provide information about Nithya Welfare Society's programs, accept donations, facilitate volunteer registrations, and enable corporate partnership inquiries. You may use this website for lawful purposes only.

3.2 Prohibited Conduct

You agree not to:

  • Use the website for any fraudulent, unlawful, or harmful purpose.
  • Attempt to gain unauthorized access to any part of the website or its systems.
  • Introduce viruses, malware, or any harmful code to the website.
  • Reproduce, duplicate, or copy any content from this website for commercial purposes without prior written permission.
  • Misrepresent your identity or affiliation when contacting us or submitting forms.

4. Donations

4.1 General Terms

  • All donations made to Nithya Welfare Society are voluntary and intended for charitable purposes.
  • Donations are processed securely through Razorpay. By making a donation, you also agree to Razorpay's terms of service.
  • Donations are accepted in Indian Rupees (INR) only unless otherwise specified.
  • The Society reserves the right to allocate donated funds to programs and activities where the need is greatest, unless a specific allocation is agreed upon in writing.

4.2 Tax Benefits (Section 80G)

What are the benefits of donating to NITHYA WELFARE SOCIETY?

You can claim tax deductions on the donations made to an NGO provided the NGO is registered under Section 80G of the Income Tax Act, 1961. Not only that, helping those in need of your support also makes you happy and fulfilled.

How is 80G donation calculated?

When you donate to NITHYA WELFARE SOCIETY, the benefit can be availed by reducing 50% of the donated amount from your taxable salary. For instance, if your taxable income per year is ₹200,000 and you make a donation of ₹5,000, then your net taxable income will become ₹197,500 (i.e. ₹200,000 – 50% of your donation). Your tax will now be calculated on this reduced taxable income based on the prevailing tax rates.

Will I (Individual/Company) get CSR certificate? If yes, when will it be issued?

We, at NITHYA WELFARE SOCIETY will provide an Individual/Company with an 80G Certificate and Utilization certificate for the CSR donations made.

  • An 80G receipt will be issued to donors upon request. Donors must provide a valid PAN number to receive the receipt.
  • The Society is not responsible for any tax-related advice. Donors are advised to consult their tax advisor for specific deduction eligibility.

4.3 Donation Refund Policy

Nithya Welfare Society follows a reliable refund policy to let our donors feel privileged about their association with us. We take utmost care about processing donations as per the mandates signed by our donors in the donor forms, both offline and online.

However, in the unlikely event of an erroneous deduction or if the Donor wants to cancel/deduct the donation, Nithya Welfare Society will respond within 14 working days from the date of receiving the complaint from the donor.

The timely refund of the wrongly deducted amount will depend on the type of card/banking instrument used during the transaction.

  • Refund Request Deadline: We require proof of deduction of the donation amount and a written communication for a refund from the donor within 48 hours after the donation.
  • Receipts: If the official receipt has already been issued, the Donor needs to return the original receipt to our official address before a refund is processed.
  • Tax Exemption: In the case where a tax exemption certificate (e.g., 80G) has already been issued, a refund will not be possible.
  • Refunds, if approved, will be processed within 14 working days to the original payment method.

4.4 Usage of Funds

Donations towards specific causes (such as Women Welfare, Medical Services, Education Aid, or Burial Support) will be used to meet the cost of those specific programs. In case of any excess funds at the end of the year/program, the funds are directed towards the general welfare of the underprivileged communities we serve.

4.5 Data Sharing Agreement

You agree to share information entered on the donation page with NITHYA WELFARE SOCIETY (owner of this page) and Razorpay, adhering to applicable laws. By making a donation, you also agree to Razorpay's terms of service and privacy policy.

5. Volunteering

  • Volunteering with Nithya Welfare Society is on a voluntary, unpaid basis. Volunteers are not employees of the Society.
  • Volunteers must be at least 18 years of age. Individuals between 16 and 18 may volunteer with written parental/guardian consent.
  • Volunteers are expected to conduct themselves in a professional and respectful manner while representing the Society.
  • The Society reserves the right to terminate a volunteer's participation at any time if their conduct is deemed inappropriate or harmful to our mission.
  • Volunteers who are issued certificates may use them for personal and professional purposes but may not claim employment with or official representation of the Society.

6. Corporate Social Responsibility (CSR) Partnerships

  • CSR partnerships are governed by individual Memoranda of Understanding (MoUs) executed between the Society and the corporate partner.
  • All CSR engagements comply with Section 135 of the Companies Act, 2013, and Schedule VII therein.
  • The Society provides quarterly impact reports to CSR partners as agreed in the partnership terms.
  • CSR funds are deployed strictly to the programs and geographies agreed upon in the MoU.
  • The Society maintains audit-ready financial records and is open to third-party audits by corporate partners upon prior notice.

7. Intellectual Property

  • All content on this website, including text, images, logos, graphics, and design, is the property of Nithya Welfare Society and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
  • You may not reproduce, distribute, or create derivative works from any content on this website without prior written permission.
  • The "Nithya Welfare Society" name and logo are proprietary marks. Unauthorized use is strictly prohibited.

8. Disclaimer of Warranties

  • This website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

Names and identifiable details may be changed to protect privacy where necessary.

11. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from the use of this website or engagement with the Society shall be subject to the exclusive jurisdiction of the courts in Guntur, Andhra Pradesh, India.

12. Amendments

Nithya Welfare Society reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on this page. Your continued use of the website after any modifications constitutes acceptance of the updated terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
